2. PRIVACY POLICY

The Company places great importance on respecting the privacy of its customers, employees and suppliers. It is with this objective in mind that the Company has established this Privacy Policy to govern the Company’s practices regarding the collection, use and disclosure of personal information.

This Policy sets out how the Company collects, uses, discloses and protects your personal information. The Company’s practices with respect to your personal information are in compliance with the Québec Act respecting the protection of personal information in the private sector and the Personal Information Protection and Electronic Documents Act (collectively the “Act”). 2.2 Collection of Personal Information

For the purposes of this Policy, “personal information” includes: any information about the personal or physical circumstances of an identified or identifiable individual.   • When you contact the Company’s customer service department or any of the Company’s employees or agents;

Please be advised that one of the reasons personal information will be collected is because you will be asked to complete and submit a form. We require this information in order to provide customer support, administer customer accounts and/or provide our services to you. The Company may use this information for marketing and sales purposes.

We do not share any of our customers’ personal information with third parties, except for internal and external service providers we use to streamline or outsource one or more aspects of the business, products and services we provide to you, unless you have given us permission to do so. 2.4 Other uses of personal information

In the event that the Company contemplates or proceeds with (i) the sale of all or part of its assets, (ii) a change of control, iii) funding, and iv) the merger with another company, personal information in its possession may be disclosed to any person required in connection with the consideration or completion of the foregoing transactions. However, such personal information should be used strictly in accordance with the Policy.

2.5 Disclosure of Personal Information

The Company will not trade, rent or sell your personal information to any third party other than as set out in the Policy without your knowledge and consent.

Notwithstanding the foregoing, the Company nevertheless reserves the right to disclose personal information to a third party in certain specific circumstances, including i) your employers to confirm the accuracy of the information provided to the Company, (ii) to law firms or collection agencies to collect debts that are due when the customer has for any reason failed to meet its obligations to the Corporation, and iii) to any person in order to comply with any applicable law or regulation or order of a court of competent jurisdiction.

2.6 Transfers to third parties and/or agents

Certain services offered through the Company may be provided by third parties in cooperation with the Company. In order to provide you with the services you request, the Company may transfer information about you to these third parties, including lenders previously approved by the Company.

When the Company needs to transfer personal information to third parties for processing on its behalf, the Company will sign an agreement with appropriate privacy provisions before any information is transferred to the third party. These arrangements must provide that the third party will use such personal information only for its own purposes, protect its confidentiality and process the information only as directed by the Company.

2.7 Accessing and Changing Your Personal Information

Requests for access to your personal information in the possession of the Company should be addressed to the person in charge at the contact information provided in section 2.1, including any questions regarding your credit report or recommendations concerning your creditworthiness.

You may update or correct any personal information about you that the Company holds by making a written request to the Manager.

Finally, you may also address any complaint regarding the Company’s compliance with the Act or the Policy to the Manager.

2.8 Consent

You may withdraw your consent to the Company’s use or disclosure of your personal information by making a request to the person responsible at the contact information set out in section 2.1. You may be asked to provide appropriate identification or to identify yourself in other ways.

In certain circumstances, the withdrawal of consent to the use or disclosure of certain personal information may result in the Company being unable to provide certain services to the individual, including providing the requested loan or service, or in any loan provided to the individual becoming due and payable.

2.9 Retention of Personal Information

You consent to the retention of your personal information by the Company once the transactions covered by it have been completed. As such, your personal information will be retained after the end of your contract with the Company.

All personal information collected by the Company is protected by reasonable security safeguards appropriate to the sensitivity of the information. Personal information held in electronic format, including all information collected through the Company’s websites, is stored in secure, confidential databases. The Company evaluates its safety equipment and procedures on a regular basis and modifies them as necessary.

 

2.10 Use of cookies

In addition to personal information, the Company uses information gathering tools such as cookies on certain pages of its Site to analyze site navigation and the effectiveness of promotional campaigns. Cookies are pieces of information that a Web site sends to a Web user’s hard drive while they are visiting a Web page. Cookies allow the site to remember important information that will make your visit to the site more useful. The Company uses cookies to enhance your subsequent visits. The Terms and the Policy shall be governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein, without giving rise to any conflict of laws principles whatsoever. Any legal proceeding, action, claim or proceeding of any kind arising out of or relating to the Site shall be brought only in the courts of the judicial district of Montreal, Province of Quebec, Canada, and to the exclusion of any other judicial district having jurisdiction.
